This proposal shows how Wrightsville Beach can use Special Use Permits (SUPs) for predictable projects that meet clear rules, and Conditional Use Permits (CUPs) for complex or high-impact projects needing tailored conditions.
Permits by Development Type
Routine shops, restaurants or offices
Permit: SUP
Reason: Meets all parking, height, stormwater and design rules.
Small building additions (≤ 25% larger)
Permit: SUP
Reason: Quick approval if rules are met.
Large redevelopments in key areas
Permit: CUP
Reason: Custom rules for traffic, parking, design, public benefits
Mixed-use (residential + commercial)
Permit: CUP
Reason: Case-by-case review for traffic, stormwater, housing mix.
Projects asking for variances
Permit: CUP
Reason: Public hearing and tailored conditions.
Public / institutional in neighborhoods
Permit: SUP
Reason: Approoved if all community standards are met.
Resident Protections
All projects posted online and at site before decision.
CUPs always have public hearing; SUPs if 25 residents request.
Both use scorecard for scale, traffic, stormwater, neighborhood fit, public benefits.
How to Add Legally
NCGS §160D allows amending the UDO:
Draft ordinance defining SUP/CUP, permit matrix, rules.
Planning Board review & public meeting.
Public notice ≥10 days before hearing.
Board hearing & majority vote.
File with Town Clerk & post online.
Other Coastal Towns Using Both
NC: Nags Head, Kill Devil Hills, Wilmington, Carolina Beach.
Other: Rehoboth Beach DE, Key West FL, Santa Cruz CA.
